DMCA Takedown Policy
1. Introduction to DMCA Compliance
Although XPLICIT is not based in the United States, we respect the intellectual property rights of copyright holders and voluntarily comply with the Digital Millennium Copyright Act (DMCA).
This DMCA Takedown Policy provides the legal framework under which we process claims of copyright infringement. By following this process, XPLICIT qualifies as a Service Provider under 17 U.S.C. § 512(k)(1) and benefits from safe harbor protections against copyright liability.
2. How to File a DMCA Notice (Takedown Request)
If you believe that your copyrighted work has been used without authorization on XPLICIT, you must send a valid DMCA notice to our Designated DMCA Agent with the following information:
- Your full name, company (if applicable), and contact information (address, phone number, email).
- A detailed description of the copyrighted work being infringed (or a representative list if multiple works are affected).
- The exact location (URL) of the infringing material on XPLICIT.
- A statement under penalty of perjury that:
- You have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
- The information provided in your DMCA notice is accurate.
- You are the copyright owner or an authorized agent acting on behalf of the copyright owner.
- Your electronic or physical signature.

3. DMCA Counter-Notice (Challenging a Takedown)
If your content was removed due to a DMCA complaint, and you believe it was wrongfully taken down, you may submit a Counter-Notice to XPLICIT.
Your Counter-Notice must include:
- Your full name, address, phone number, and email.
- Identification of the removed content, including its previous URL.
- A statement under penalty of perjury that you have a good faith belief the material was removed due to misidentification or error.
- A statement consenting to the jurisdiction of the courts in which XPLICIT operates, and agreeing to accept service of process from the original complainant or their agent.
- Your electronic or physical signature.

XPLICIT will review all Counter-Notices and, unless legal action is taken by the original claimant within 10-14 days, may restore the disputed content.
4. Repeat Infringers and Policy Violations
XPLICIT enforces a strict policy against repeat copyright infringement. If a user repeatedly violates copyright laws, XPLICIT may:
- Suspend or terminate the account without prior notice.
- Permanently ban the user from using XPLICIT services.
- XPLICIT reserves the right to report serious violations to appropriate authorities.
5. Legal Disclaimer
- Submitting false or fraudulent DMCA notices may result in legal liability under 17 U.S.C. § 512(f).
- XPLICIT does not waive any legal rights and will comply fully with all applicable copyright laws.
